1. Acceptance of Terms
By downloading, accessing, or using the HelperBridge mobile application, website, and related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. HelperBridge is a platform owned and operated by NovaBranch Pte. Ltd. Throughout these Terms, “HelperBridge”, “we”, “us”, and “our” refer to NovaBranch Pte. Ltd. If you do not agree to these Terms, you must immediately cease use of the Platform.
2. Nature of the Service (Strictly an IT Platform, Not an Employment Agency)
HelperBridge provides a digital classifieds platform and communication tool to connect prospective employers (“Employers”) with migrant domestic workers (“Helpers”).
- Platform Only: HelperBridge operates strictly as an electronic bulletin board and information technology platform. We are not a licensed employment agency, recruiter, broker, or employer under the Singapore Employment Agencies Act (EAA).
- No Agency Activities: We do not participate in the negotiation of employment terms, handle Ministry of Manpower (MOM) paperwork (e.g., In-Principle Approvals), mediate employment disputes, or collect placement fees or salary deductions from Helpers.
- MOM Compliance: Users are strictly and solely responsible for ensuring that all hiring processes, work passes, medical examinations, insurance and security bond purchases, and employment contracts comply fully with the regulations set by the MOM in Singapore.
- No Guarantee: We do not guarantee the accuracy of user profiles, the quality or safety of the jobs posted, the truthfulness of references, or the ability of Helpers to deliver services.
3. Prohibition on Commercial Employment Agencies
The Platform is strictly for direct, peer-to-peer hiring between individual Employers and Helpers.
- Licensed Employment Agencies (EAs), unlicensed recruiters, or third-party brokers are strictly prohibited from creating accounts, browsing profiles, or soliciting Helpers on this Platform.
- Any commercial entity found scraping, harvesting, or using HelperBridge data to poach domestic workers for offline placement will face immediate account termination without refund, and HelperBridge reserves the right to report such activities to the MOM and seek civil damages.
4. User Accounts, Verification, and Data Privacy (PDPA)
- Eligibility: You must be at least 18 years old to create an account. Helpers utilizing the platform must legally meet MOM’s age and eligibility requirements to hold a Work Permit in Singapore.
- Accuracy: You agree to provide true, accurate, and complete information. Creating fake profiles or impersonating another person is strictly prohibited.
- Identity Verification & PDPA: HelperBridge may require you to upload identity documents (e.g., SGWorkPass screenshots) for verification purposes. In strict compliance with Singapore’s Personal Data Protection Act (PDPA), users are required to mask, blur, or redact their full Foreign Identification Number (FIN) and NRIC before uploading any documents. HelperBridge reserves the right to delete non-compliant documents from our servers without notice.
- Not a Background Check: While we take reasonable steps to verify users via OTP and document checks, this does not constitute a comprehensive criminal or background check. Users must exercise their own independent judgment and caution before entering into any employment agreements.
5. Subscriptions and Payments
HelperBridge offers optional “Premium” subscriptions or one-time payments to unlock advanced features (e.g., unlimited direct messaging).
- Billing: Subscriptions and fees may be billed through your Apple App Store account, Google Play Store account, or via secure third-party web payment methods (e.g., Stripe) upon confirmation of purchase.
- Auto-Renewal: App Store subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Cancellations: You can manage or cancel your subscription at any time via your respective device or web account settings. Deleting your HelperBridge account or uninstalling the app does not automatically cancel your subscription.
- No Guarantees of Hire: Purchasing a subscription or unlocking a chat does not guarantee that a Helper will respond, agree to an interview, or successfully transfer to your employment.
- Refunds: All payments are final. Payments processed via Apple or Google are subject strictly to their respective refund policies. HelperBridge cannot issue direct refunds for app store purchases or for unresponsive users.
6. User-Generated Content (UGC) and Safety
HelperBridge maintains a zero-tolerance policy for objectionable content and abusive users. You agree NOT to use the Platform to:
- Harass, abuse, threaten, or discriminate against another user.
- Submit false, misleading, or fraudulent references and documents.
- Use the platform for any illegal activities, including human trafficking, forced labor, illegal deployment, or avoiding MOM levies.
- Post pornographic, explicit, or highly offensive material.
Moderation: HelperBridge provides in-app features to “Block” and “Report” abusive users. We reserve the absolute right to actively moderate chats, remove content, and permanently suspend or ban accounts that violate these rules, without prior notice or liability.
7. Disclaimers and Limitation of Liability
- “As-Is” Basis: The Platform is provided on an “as is” and “as available” basis without any warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
- User Disputes: HelperBridge is never a party to any agreement, contract, or dispute between an Employer and a Helper.
- Limitation of Liability: To the maximum extent permitted by Singapore law, HelperBridge, its founders, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages (including financial loss, MOM fines, physical harm, or legal penalties) arising out of your use of the Platform. In no event shall our total liability to you exceed the total amount you paid to HelperBridge in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless HelperBridge, its founders, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising directly or indirectly from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any MOM regulations or Singapore laws; or (d) any dispute or legal action between you and another user of the Platform.
9. Changes to the Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the “Last Updated” date at the top of this page. Continued use of the Platform after changes have been made constitutes your acceptance of the new Terms.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
